These Terms of Use govern access to and use of the websites, products, services, ordering tools, quote forms, content, and online features provided by Paragon Print Systems, Inc., doing business through BarcodeFactory.com and related websites, including www.paragonprintsystems.com and www.barcodefactory.com.

By accessing or using our website, submitting a form, requesting a quote, placing an order, creating an account, communicating with us, or purchasing products or services from us, you agree to these Terms of Use. If you do not agree, you should not use our website or services.

1. Company Information

Paragon Print Systems, Inc. is located at 2021 Paragon Drive, Erie, PA 16510. BarcodeFactory.com is a website brand of Paragon Print Systems, Inc.

2. Website Use and Business Users

You may use our website only for lawful business or personal purposes related to reviewing products, requesting quotes, purchasing products or services, communicating with us, or obtaining information about our company and offerings.

Our websites, products, and services are primarily intended for business users, commercial customers, government entities, schools, healthcare organizations, manufacturers, distributors, and other organizations.

3. Website Accessibility

We are committed to providing access to our website, products, services, and information to all users, including individuals with disabilities. If you have difficulty accessing any content, feature, product information, form, document, or ordering function on our website, please submit an accessibility request through our Accessibility Request Form.

Accessibility requests submitted through the form will be routed internally to accessibility@paragonprintsystems.com for consistent handling by designated personnel. To reduce the risk of misrouting or inconsistent responses, accessibility requests should be submitted through the Accessibility Request Form and not by phone.

4. Prohibited Use and Bad-Faith Conduct

You may not use our website, forms, ordering systems, communication tools, account features, or other services for unlawful, fraudulent, abusive, deceptive, disruptive, harassing, or bad-faith purposes.

  • Submitting false, misleading, incomplete, or deceptive information.
  • Impersonating another person, company, customer, or representative.
  • Attempting to manufacture, solicit, or create legal claims through bad-faith website interactions.
  • Using website tools in a manner inconsistent with normal commercial inquiry or purchasing activity.
  • Attempting to interfere with website security, operations, availability, or performance
  • Scraping, harvesting, copying, or extracting website content, pricing, product data, customer data, or other information without authorization.
  • Using bots, scripts, crawlers, automated tools, or similar technologies without our written consent.
  • Using automated accessibility, privacy, security, or compliance scanning tools in a manner that disrupts website performance or exceeds normal website usage without prior written authorization.
  • Attempting to probe, test, scan, or bypass website security or access controls.
  • Submitting malicious code, spam, excessive requests, or abusive communications.
  • Misrepresenting your identity, residency, disability status, consumer status, authority, or relationship to our company when submitting requests, claims, forms, chats, orders, or other communications.
  • Using our website to engage in fraud, chargeback abuse, identity misuse, payment misuse, or unauthorized purchasing activity.

We reserve the right to block access, refuse service, cancel orders, preserve records, investigate misuse, suspend or terminate accounts, and take legal action where we believe our website, systems, employees, customers, vendors, or business operations are being misused or targeted in bad faith.

5. Account Registration and Security

Some website features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We may suspend or terminate an account if we believe account information is inaccurate, unauthorized, fraudulent, abusive, or otherwise in violation of these Terms.

6. Product Information

We attempt to provide accurate product descriptions, specifications, images, pricing, availability, compatibility information, and related content. Errors, omissions, manufacturer changes, discontinued items, typographical mistakes, and availability changes may occur. Product images may be representative and may not show the exact configuration, accessory, packaging, revision, color, or option.

You are responsible for confirming that a product is suitable for your intended use before purchase. If you have questions about compatibility, application, printer model, scanner model, software version, label material, adhesive, ribbon, RFID inlay, or related requirements, please contact us before ordering.

7. Pricing, Quotes, and Availability

All prices, quotes, promotions, and availability are subject to change without notice unless otherwise stated in a written quote issued by us. We reserve the right to correct pricing errors, product errors, freight errors, tax errors, availability errors, or other mistakes before or after an order is submitted.

Quotes are valid only for the period stated on the quote. If no period is stated, the quote is valid for 30 days unless withdrawn or revised earlier.

8. Orders and Acceptance

Submitting an order through our website, by email, by purchase order, or by any other method does not guarantee acceptance. An order is accepted only when we confirm acceptance, process payment, issue an order acknowledgment, ship the product, or otherwise confirm acceptance in writing.

We reserve the right to reject, cancel, hold, or limit any order for any lawful reason, including product availability, credit approval, suspected fraud, pricing or product errors, manufacturer restrictions, export restrictions, marketplace resale concerns, payment issues, or failure to comply with these Terms.

9. Payment Terms and Credit Approval

Payment terms are subject to approval by Paragon Print Systems, Inc. We may require prepayment, ACH, wire transfer, credit card payment, deposit, personal guarantee, or other payment arrangements at our discretion. Open credit terms, if granted, may be changed, suspended, or revoked at any time.

10. Taxes

Prices generally do not include sales tax, use tax, VAT, duties, customs fees, import fees, brokerage fees, or similar charges unless expressly stated. You are responsible for all applicable taxes, fees, duties, or charges related to your order.

11. Shipping, Delivery, Risk of Loss, and Freight

Shipping dates, delivery dates, lead times, and transit times are estimates only and are not guaranteed unless expressly agreed in writing. Freight charges, fuel surcharges, accessorial charges, residential delivery fees, liftgate fees, inside delivery fees, limited access fees, brokerage charges, customs charges, and similar charges may be billed separately or adjusted after shipment if assessed by the carrier.

12. Returns and Cancellations

Returns require prior written authorization from Paragon Print Systems, Inc. / BarcodeFactory.com. A Return Material Authorization number, or RMA, must be issued before any product is returned. Products returned without an RMA may be refused, returned to sender, or held without credit.

Standard Stock Products

Standard stock products may be eligible for return within 30 days of purchase, subject to our review and approval.

To be considered for return, the product must be:

  • Unused and undamaged.
  • In its original manufacturer packaging.
  • Complete with all original parts, accessories, manuals, inserts, packaging materials, and contents.
  • Returned in a clean original box with no writing, labels, damage, or shipping markings on the manufacturer's box.
  • Over-boxed for return shipment so the original packaging remains in resalable condition.

Issuance of an RMA does not guarantee credit. Returned products are subject to inspection before credit is issued.

Restocking Fees and Return Freight

Depending on the product, manufacturer, supplier, and reason for return, restocking fees may apply. We make reasonable efforts to avoid or minimize restocking fees where possible; however, some fees are required by the manufacturer or supplier and are outside our control.

Unless otherwise agreed in writing, the customer is responsible for return freight. Original shipping charges, expedited freight charges, handling fees, special freight charges, brokerage charges, duties, taxes, and accessorial freight charges are non-refundable.

Stock Labels, Tags, Ribbons, and Media

Stock media includes standard stock labels, tags, ribbons, receipt paper, and similar consumable products.

Stock media may be eligible for return within 30 days of purchase only if it is unused, unopened, undamaged, in its original packaging, and only with prior return authorization.

Opened, used, damaged, partially used, written-on, relabeled, repackaged, exposed to unsuitable storage conditions, or improperly stored media is non-returnable.

Non-Cancelable and Non-Returnable Products

The following products are non-cancelable and non-returnable unless we expressly agree otherwise in writing:

  • Custom products.
  • Made-to-order products.
  • Custom labels, custom tags, custom ribbons, custom printed materials, and other customer-specific media.
  • Special-order products.
  • Configured equipment.
  • Software that has been opened, downloaded, activated, registered, licensed, renewed, or delivered electronically.
  • Opened or used consumables.
  • Opened or used OEM labels, ribbons, tags, or media.
  • RFID products, unless specifically approved in writing before return.
  • Products not normally stocked by Paragon Print Systems, Inc.
  • Products subject to manufacturer, supplier, or publisher non-returnable restrictions.

Manufacturer-Specific Return Restrictions

Some manufacturers impose additional return restrictions, restocking fees, inspection requirements, warranty-only remedies, or non-returnable policies. These manufacturer rules are in addition to our standard return requirements.

Current examples include, but may not be limited to:

  • Toshiba printers and printer parts - non-returnable except for manufacturer defects.
  • CAB printers and CAB printer parts - subject to manufacturer restocking fees except for manufacturer defects.
  • Tach-It products - non-returnable.
  • Avery/Novex printers and print heads - non-returnable except for manufacturer defects.
  • Epson ColorWorks printers - non-returnable except for manufacturer defects.
  • Afinia Color printers - non-returnable except for manufacturer defects.
  • VIP Color printers - non-returnable except for manufacturer defects for legacy products or prior sales, if applicable.

Defective Products and Exclusive Remedy

If a product is defective, the customer's sole and exclusive remedy is limited to the applicable manufacturer warranty process, repair, replacement, exchange, credit, or refund for the defective product itself, as determined by Paragon Print Systems, Inc. and/or the applicable manufacturer or supplier.

To the fullest extent permitted by law, Paragon Print Systems, Inc. is not responsible for labor charges, installation costs, removal costs, reinstallation costs, diagnostic time, travel time, downtime, lost productivity, lost profits, lost revenue, lost business, loss of data, production delays, operational interruptions, substitute equipment, customer penalties, chargebacks, or any incidental, indirect, consequential, special, punitive, or enhanced damages arising from a defective product, delayed product, incompatible product, warranty issue, repair, replacement, or failure of product performance.

Products claimed to be defective may require manufacturer inspection, troubleshooting, serial-number verification, photographs, diagnostic information, or return of the product before repair, replacement, exchange, credit, or refund is approved. A product determined not to be defective may be returned to the customer and may be subject to inspection, testing, freight, restocking, or other charges.

Cancellations

Orders for standard stock products may be canceled only if the order has not yet shipped, been processed for shipment, been transferred to a supplier, been configured, or otherwise entered fulfillment.

Orders for custom products, made-to-order products, special-order products, configured equipment, software, RFID products, and non-stock products may not be canceled once accepted, ordered, configured, produced, licensed, activated, or placed into production.

13. Custom Labels, Tags, Ribbons, RFID Products, and Printed Materials

Custom or made-to-order products are produced based on the specifications, artwork, approvals, files, materials, dimensions, quantities, tolerances, cores, wind direction, adhesives, face stocks, liners, ribbons, RFID inlays, print methods, and other information provided or approved by the customer.

You are responsible for reviewing and approving all proofs, specifications, artwork, dielines, dimensions, copy, barcodes, QR codes, colors, materials, adhesives, and application requirements before production.

14. Manufacturer Policies and Resale Restrictions

Some products are subject to manufacturer channel policies, resale restrictions, export restrictions, software license terms, warranty limits, marketplace restrictions, or other requirements. You agree to comply with all applicable manufacturer policies and restrictions, including restrictions on unauthorized resale, diversion, export, online marketplace resale, or sale through prohibited channels.

Zebra Technologies products are sold subject to Zebra channel, end-user, warranty, and resale policies. Unless expressly authorized in writing by Zebra Technologies and Paragon Print Systems, Inc., Zebra products purchased from us may not be purchased for resale, diversion, brokering, liquidation, or listing on third-party websites, online marketplaces, auction platforms, or similar open-market channels.

Prohibited channels include, but are not limited to, Amazon, Amazon Marketplace, eBay, Walmart Marketplace, Newegg, Facebook Marketplace, Alibaba, Craigslist, auction sites, liquidation sites, marketplace reseller sites, and similar third-party or open-market platforms.

We may require end-user information, intended-use information, project details, resale certifications, serial-number records, or signed acknowledgments before accepting or fulfilling orders involving Zebra Technologies products or other manufacturer-restricted products. We may reject, cancel, hold, or refuse future orders if we believe products may be diverted, resold through unauthorized channels, or used in violation of manufacturer policy.

15. Software, Licenses, Cloud Services, and Subscriptions

Software, cloud services, subscriptions, support plans, and license products are subject to the applicable publisher or manufacturer license agreement, subscription terms, renewal terms, activation rules, user limits, device limits, cancellation rules, and support policies. Software, licenses, subscriptions, and digital products may be non-returnable and non-cancelable once issued, activated, downloaded, registered, renewed, or delivered.

16. Product Use, Compliance, and Application Responsibility

You are responsible for determining whether products purchased from us are suitable for your intended use, environment, industry, application, regulatory requirement, labeling requirement, compliance requirement, or customer specification. This includes food labeling, healthcare labeling, medical environments, cleanrooms, freezer applications, chemical exposure, outdoor use, RFID performance, asset tracking, shipping compliance, barcode grading, UL/CSA requirements, FDA-related requirements, Prop 65, REACH, RoHS, PFAS, BPA, BPS, food-contact, and other standards or regulations.

17. Warranties

Products may be covered by manufacturer warranties, if any. Manufacturer warranty terms vary by product and manufacturer. Except as expressly stated in writing by Paragon Print Systems, Inc., we do not provide additional warranties beyond those provided by the manufacturer.

To the fullest extent permitted by law, products and services are provided as is and as available, and we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and suitability for a specific application.

18. Services, Installation, Repair, and Support

Any services we provide, including installation, configuration, repair, troubleshooting, consultation, software support, training, or technical assistance, are subject to the scope, assumptions, limitations, and pricing stated in the applicable quote, statement of work, service order, or written communication. Unless expressly agreed in writing, services do not guarantee a specific business outcome, production result, read rate, scan rate, software result, system performance level, or compatibility result.

19. Website Communications and Recordkeeping

When you communicate with us through website forms, quote requests, account tools, order submissions, email, file uploads, or other non-chat communication methods, you understand that we may collect, store, review, and use those communications and related records for customer service, order processing, quoting, sales support, quality assurance, security, fraud prevention, dispute resolution, recordkeeping, legal compliance, and business operations.

Live chat disclosures and consent requirements are addressed separately from these Terms.

20. Privacy

Your use of our website and services is also governed by our Privacy Policy. We do not sell personal information for money. We do not sell customer order information, quote information, customer service communications, live chat transcripts, website inquiry information, privacy requests, or accessibility requests.

We may disclose personal information to service providers and business partners that help us operate our business, including payment processing, shipping, tax calculation, email delivery, website hosting, data storage, fraud prevention, analytics, customer service, marketing support, legal services, accounting services, and information security.

21. Cookies, Tracking Technologies, and Privacy Choices

Our website uses cookies and similar technologies to operate the website, maintain security, remember preferences, support shopping cart and account functions, understand website performance, improve user experience, and support marketing or advertising where permitted. Where required, non-essential cookies will be blocked until the user has accepted the applicable cookie category.

If we use advertising, retargeting, analytics, cross-context behavioral advertising, or similar technologies that may be considered a sale, sharing, or targeted advertising under applicable privacy laws, users may opt out through our Privacy Choices, Do Not Sell or Share My Personal Information, or Cookie Preferences tools. We will honor legally required opt-out preference signals where required by applicable law.

22. Privacy Requests

To ensure privacy requests are properly routed, verified, logged, and answered by designated personnel, privacy requests should be submitted through our Privacy Request Form. Form submissions will be routed internally to privacy@paragonprintsystems.com. Privacy requests should not be submitted by phone.

Depending on your location and applicable law, you may have the right to request access, correction, deletion, a copy of personal information, opt out of certain sales or sharing, opt out of targeted advertising, limit certain uses of sensitive personal information, or appeal a privacy request decision.

23. Children and Minors

Our websites, products, and services are intended for business users, commercial customers, government entities, schools, healthcare organizations, manufacturers, distributors, and other organizations. Our websites are not directed to children or minors, and we do not knowingly collect personal information from children under 13 or from minors for purposes of sale, sharing, targeted advertising, or profiling.

We do not knowingly allow children or minors to create accounts, place orders, submit quote requests, or provide personal information through our websites. If we learn that we have collected personal information from a child or minor in a manner that requires parental consent, deletion, opt-in consent, or other action under applicable law, we will take appropriate steps to delete, restrict, or otherwise handle that information as required.

24. Marketing Communications and Email

We may send marketing or promotional communications to customers, prospects, and business contacts where permitted by law. Commercial emails from us will identify the sender, use accurate header information, avoid deceptive subject lines, include our physical mailing address, and provide a method to unsubscribe where required. For Canadian recipients, we will send commercial electronic messages only where permitted by Canada's Anti-Spam Legislation, including applicable consent, identification, and unsubscribe requirements.

25. Limitation of Liability

To the fullest extent permitted by law, Paragon Print Systems, Inc., BarcodeFactory.com, and their officers, directors, employees, agents, affiliates, suppliers, manufacturers, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost business, lost data, business interruption, loss of goodwill, or cost of substitute goods or services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the website, products, services, communications, orders, quotes, or transactions will not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

26. Governing Law, Venue, Class Action Waiver, and Jury Waiver

These Terms and any dispute, claim, order, transaction, communication, product, service, or website use arising out of or relating to Paragon Print Systems, Inc., BarcodeFactory.com, or our websites will be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. To the fullest extent permitted by law, any lawsuit, claim, or legal proceeding shall be brought exclusively in the state or federal courts located in or serving Erie County, Pennsylvania.

To the fullest extent permitted by law, disputes must be brought only on an individual basis and not as a class, collective, representative, or private attorney general action. You and Paragon Print Systems, Inc. knowingly and voluntarily waive any right to trial by jury in any dispute arising out of or relating to these Terms, the website, any order, transaction, communication, product, or service.
